Three Queensland university students who faced court over racial vilification accusations may be facing an appeal, after plaintiff Cindy Prior lodged an application to appeal on Tuesday afternoon.
The racial hate case for $250,000 was brought against the three students by Ms Prior over alleged racist posts made in May 2013 over the use of an Indigenous-only computer laboratory.
Ms Prior went on stress leave from her job following the Facebook posts and has not returned to the Queensland University of Technology.
The case – which has brought increased scrutiny on section 18c of the Racial Discrimination Act – was thrown out of the Federal Court last month.
The grounds for appeal are not yet known, but special leave to appeal will need to be granted as the application was not lodged within 14 days.
