Former Don Dale detainee Dylan Voller is applying to be released from prison because of mistreatment he received while in detention.
Voller this week told the Royal Commission that he had been denied food and water by guards as a youth detainee and was transported vast distances in a non-air-conditioned van.
Voller’s lawyer Peter O’Brien says the judge failed to take into account this mistreatment when he was sentenced in 2014.
Mr O’Brien says he will put forward alternate detention options in the application to be heard in the Supreme Court next week.
Voller is currently serving a sentence of more than three years for aggravated robbery and is not due for release until October 2017.
