In the Northern Territory an Indigenous man who spent more than 100 days in prison has been released on bail after CCTV footage emerged showing he was not responsible for the assault he had been charged over.

Zarak Bolga, 44, was charged with aggravated assault and breaching a domestic violence order after his partner was assaulted outside Darwin’s Mindil Beach Casino.

Police and prosecutors denied the existence of the CCTV footage, which prompted the man’s lawyer to subpoena a copy from the casino.

At a bail hearing on Thursday the footage was shown to the Darwin Local Court which shows an unidentified woman carrying out the attack.

Patrick McNally from the North Australian Aboriginal Justice Agency says he has “very serious issues” with the police investigation of his client and requested the officer in charge of the investigation be summoned to court.
